This dual role involves managing ASIC''s relationship with the external law firms (Panel Firms) on our newly established Enforcement Litigation Panel and acting as Litigation Counsel on regulatory civil litigation matters. You will establish trusted, proactive, and value-driven relationships with the Panel Firms, working closely with the Legal Operations team establishing frameworks, metrics, and KPIs to assess and manage the performance of Panel Firms. You will also be working on high-profile, challenging, and rewarding regulatory litigation. The team comprises Enforcement Legal Services, Regulatory Legal Services, Corporate Legal Services, the Hearing Delegates Panel, and the newly formed Legal Operations Team.Enforcement Legal Services conducts ASIC''s hybrid civil litigation practice. Regulatory civil litigation is either managed by an external law firm with a Litigation Counsel supervising the litigation strategy or conducted by ASIC''s in-house practice with a Litigation Counsel acting as solicitor on the record and leading a team of in-house lawyers.Your roleAs the Enforcement Litigation Panel Manager, you will manage the Panel Firms by communicating ASIC''s litigation strategy, goals, and timeframes to the Panel Firms. You will acquire and maintain knowledge of each firm''s experience and skills to make informed recommendations. Additionally, you will monitor and work with the Panel Firms to improve litigation spend and value delivered, ensuring strong relationships by addressing any significant service delivery issues.As Litigation Counsel, you will provide strategic leadership and advice in regulatory civil matters involving external legal firms and offer guidance to ASIC''s investigation teams on the conduct of investigations. You will also participate in the professional development of other lawyers and contribute to building ASIC''s knowledge base.It is a great opportunity to establish strong relationships with Enforcement teams, the Civil Litigation Team, the Legal Operations team, and the Procurement team. You will explore service innovation with Panel Firms and promote value-added services. Engaging with peers in other Commonwealth Agencies and relevant organisations, you will share best practices in managing external legal resources. You will be supporting the Legal Operations team to prepare papers and reports for the Legal Services leadership, the Executive, and the Commission regarding the utilisation of external legal resources.About youTo be eligible for this role, you must have a current unrestricted Practising Certificate and admission to practice in the High Court, Federal Court, and State Supreme Courts. You should have relevant experience in managing law firms in the delivery of external legal services in the private or government sector. Extensive experience in conducting civil litigation (minimum of 10 years post-admission) is required, including developing litigation case theories and strategies in complex cases, and drafting or settling pleadings and submissions.You must demonstrate superior client service, working closely with internal clients to achieve regulatory outcomes while maintaining independence and managing legal risk. High-level communication and stakeholder engagement skills are essential, enabling you to effectively communicate with a wide range of stakeholders, including Commissioners and Senior Executives, and provide concise written and oral advice.See the Position Description for each role for more information.
