About The AntiDumping Commission We are Australias international trade remedies authority the AntiDumping Commission. Commission staff investigate alleged unfair trade practices involving goods entered Australia. These investigations seek to deliver a level playing field for industry. We administer Australias antidumping legislation and operate a connected team of professionals with investigative, accounting, auditing, business, learning and development, legal, economic, and international trade skills. About The Team The Legal Branch, led by the Executive Director, Legal (EDL), is a small supportive team of lawyers with expertise in regulatory, administrative and trade remedies law. The team works closely with the Investigations Branch and the Strategy and Operations Branch. Work in the Legal Branch is fastpaced, intellectually challenging and rewarding, providing highquality legal advice in a collegial culture. The Opportunity Our Senior Legal Counsels work independently under limited direction/supervision from the Principal Legal Counsels in performing their role and providing clientfocused specialist legal advice and support to the commission staff. Senior Legal Counsels are part of commissionwide teams undertaking antidumping investigations, providing advice throughout investigations and subsequent review processes. They identify practicerelated improvements to enhance the commissions outcomes and keep the regulator informed by developments in foreign jurisdictions and the World Trade Organizations jurisprudence. Our Ideal Candidate 23 years postadmission experience. Experience providing clientfocused, solutionsoriented, evidencebased legal advice, including identifying legal requirements, risks and developing compliant options. Experience advising on statutory interpretation and administrative law. Highly developed collaboration and advocacy skills. Welldeveloped planning and organisational skills. Aptitude for leadership and mentoring experience. High standards of professional and personal integrity. Knowledge of, or the ability to quickly acquire knowledge of, Australias antidumping legislation (Part XVB of the Customs Act 1901) and its obligations under the World Trade Organization AntiDumping Agreement and the Agreement on Subsidies and Countervailing Measures. Legal experience in advisory, government/regulatory practice or litigation in areas such as international trade, administrative/public law, or competition law is highly regarded. What You Will Do Provide clientfocused legal services to investigators, including those from nonlegal backgrounds. Deliver effective legal advice verbally and in writing on trade remedies law, evidentiary matters, and investigation practice/procedure. Exercise sound judgement in escalating matters to your Principal Legal Counsel. Manage merits review matters, including drafting submissions and participating in conferences with the AntiDumping Review Panel members, and provide input to judicial reviews. Monitor developments in the AntiDumping Review Panel, the Federal Court, and the World Trade Organization and advise on related systemic changes. Identify opportunities for continuous practice and operational improvement aligned to the commissions strategic direction. Provide input to develop legislation and policy. Mentor and supervise junior lawyers and paralegals. Actively contribute to a positive, productive, and collaborative team environment across the commission. Perform the role and manage workload in accordance with the APS Values and Code of Conduct and internal AntiDumping Commission procedures. Eligibility Tertiary qualifications in law and admission as a legal practitioner of the High Court or the Supreme Court of a State or Territory of Australia. Eligible for a practising certificate issued by the Law Society of the ACT or in your state or territory of residence. To be eligible for employment in the APS and the department, candidates must be Australian Citizens. Positions require a Baseline security clearance. Successful candidates will be required to obtain and maintain a clearance at this level. Notes A minimum of 23 years postadmission experience is preferred. Experience working with a regulator or in a regulatory setting is desirable. Limited domestic travel may be required. The department offers flexible work opportunities for many roles.
