The Alberta Crown Prosecution Service (ACPS) prosecutes people charged with Criminal Code, Youth Criminal Justice Act, and provincial statute offences. The ACPS promotes safe communities by vigorously prosecuting cases involving serious and violent crime and working with individuals and organizations in the community to identify and implement improved and alternative approaches to the administration of criminal justice. In addition, the ACPS develops criminal law policy for the province and supports criminal law consultation with other levels of government. The Alberta Crown Prosecution Service (ACPS) has an opportunity for an innovative and energetic Crown prosecutor to join the Edmonton Crown Prosecution Office. As a Crown prosecutor, you will help deliver justice through fearless, fair and effective prosecutions. The daily responsibilities of Crown prosecutors encompass a multitude of duties, such as: bail, charge screening, early case resolution, alternative measures, whether to proceed to trial or discontinue a prosecution, conduct of all prosecutions, entering a stay of proceedings, withdrawing charges, plea resolution, provision of disclosure, electing to proceed summarily or by indictment, taking a position on sentence, drafting legal opinions/briefings, dealing with victims, witnesses and police, and launching appeals. The successful candidate will: - Assess and determine what is in the public interest. - Exercise prosecutorial discretion independently of extraneous pressures or improper influences. - Ensure that decisions are made in consultation with colleagues in the prosecution of the case, superiors and investigators when required. - Accurately summarize or refer to evidence or testimony. - Determine appropriate charges, have discussions with defense counsel, interview witnesses and other parties in preparation for trial, and conduct examinations in the courtroom. - Draft legal opinions/briefings and court documents professionally and appropriately. - Deal effectively with participants of the justice system such as victims, witnesses, Court Services staff, investigators, defense lawyers, and the public. - Demonstrate organized and persuasive advocacy skills. - Demonstrate principled and effective negotiation skills. A Bachelor of Laws (LLB) or Juris Doctor (JD), and active membership or immediate eligibility for membership with the Law Society of Alberta is required. - Crown Prosecutor 1: 0 - 4 years of legal experience is required. - Crown Prosecutor 2: a minimum of 4 years of legal experience is required. - Crown Prosecutor 3: a minimum of 11 years of legal experience is required. - Crown Prosecutor 4: a minimum of 11 years of legal experience is required. Required Eligibility for Alberta Call to Bar or active membership. Assets - Strong litigation experience, preferably in criminal law. - Trial preparation and trial experience. - Prosecution experience in criminal law. For Law degrees obtained outside Canada, proof of accreditation from the National Committee on Accreditation (NCA) is required. This competition may also be used to fill future permanent and temporary positions at the same or lower classifications in the Edmonton Office or elsewhere in the ACPS.
