We are currently engaged in trademark matters and are seeking a skilled lawyer to support our brand protection strategy in Canada.Role DescriptionWe are looking for an experienced Canadian lawyer with a strong background in trademark prosecution, opposition, and litigation to represent and advise Thinkof before the Canadian Intellectual Property Office (CIPO), the Trademarks Opposition Board (TMOB), and the Federal Court of Canada. This role requires strategic thinking, strong writing skills, and the ability to develop a winning approach against large, established brands.Key ResponsibilitiesRepresent Thinkof in CIPO trademark opposition, expungement, and Federal Court litigation mattersDevelop and execute legal strategies to protect the Thinkof brand across Canadian jurisdictionsConduct legal research and draft motions, statements of opposition, counter-statements, evidence, and written argumentsAdvise on Nice Classification, brand expansion, and goods/services coverage under the Trademarks ActManage trademark filings, renewals, and Madrid Protocol designations into Canada where applicableCollaborate with leadership on long-term IP strategy, including coordination with U.S. and international counselQualificationsCalled to the bar in at least one Canadian province or territory and in good standing with the relevant Law SocietyRegistered Trademark Agent with CIPO (preferred) or actively working toward registrationDemonstrated experience in Canadian trademark law, including search, filing, prosecution, opposition, and litigationWorking knowledge of the Trademarks Act, Trademarks Regulations, and CIPO practice noticesExperience managing domain name disputes (CDRP, UDRP) is an assetExcellent analytical, research, and written advocacy skillsJuris Doctor (JD) or Bachelor of Laws (LLB) from an accredited Canadian law school (or NCA-accredited equivalent)Ability to work independently in a fully remote environmentBroader IP experience (copyright, patents, industrial designs) is a plusWhat We OfferOpportunity to lead Canadian trademark strategy for a growing brandDirect collaboration with company leadershipFlexible engagement structure (contract or part-time initially, with potential for an ongoing counsel role)
