Required Skills and Experience *- 5-8 years of experience- 3-5 years of experience with a strong understanding of education law, civil servicegovernmentmunicipal law, or employment law- Strong policy development experience- Active bar in NY- Comfortable with 5 days a week onsiteNice to Have Skills and ExperienceJob Description *1.0 Basic Function:Provides in-house general legal counsel to the District Superintendent and designated staff, board of education, to the region's superintendents and other pertinent district staff including interpretation and research as appropriate. Assists the District Superintendent in the areas of labor relations, labor negotiations, contracts, policy development and revision, personnel issues, and legal matters pertaining NYS and Federal Education laws and regulations, NYS Civil Service laws, and other NYS laws and regulations impacting schools. Serves as a member of the their school Executive Team and promotes the mission, vision, and core values of their school district.2.0 Responsibilities:2.1 Provides the District Superintendent and administrative staff day-to-day guidance on all legal matters relating to NYS and Federal Laws and regulations, including but not limited to student matters, contracts, employee matters, grievances, data security, and business matters.2.2 Assists the District Superintendent, relevant administrators and board of education in the design and strategy for contract negotiations in consultation with the Boardoutside counsel.2.3 Assists in the development of management proposals for collective bargaining sessions within the district and participates in labor negotiations..2.3 Provides advice to component schools, including school administrators and boards of education, on matters relating to NYS and Federal laws and regulations.2.4 Develops and keep up to date board policies and procedures in consultation with their District Superintendent and pertinent administrators andensures that these align with NYS laws and NYSED rules and regulations. Provides interpretation and clarification of policies and procedures to those who implement them.2.5 Works closely with the Boardoutside counsel on legal matters and makes referrals as appropriate. Coordinates services provided by Boardoutside counsel including administering contracts and reviewing billing.2.6 Represents the school and component school districts before PERB and other governmental bodies when requested.2.7 Assists the District Superintendent and school administrative staff in formulating positions on legal concerns that may arise.2.7.1 Reviews contract agreements, licenses, and grantscontracts to protect the school from liabilities and to ensure alignment with their board policies, and NYS governmental laws.2.7.2 Assists the Medicaid Compliance Officer in legal matters, undertakes audits as requested, provides legal advice relating to Medicaid compliance, and submits Medicaid compliance certifications as needed.2.7.3 Conducts professional development and training programs including preparing training materials for their staff and Board members. Topics may include legal issues, Sexual harassment, workplace violence, Medicaid Compliance, DASA, Reporting of Child Abuse in an Educational Setting among others.2.7.4 Conducts student and staff investigations in response to complaints and works closely with Boardoutside counsel when necessary.2.8 Develops response to FOIL requests and maintains required documentation.2.10 Reviews and certifies leases for their facilities and submit to the NYS State Education department for approval.2.11 Assists with compliance of the NYS Open Meeting Laws.2.12 Serves as hearing officer related to student andor staff grievances, complaints, and disciplinary for them and their component districts as pertinent.2.13 Develops relevant services that may be of interest to component school districts; provides those services to component school districts, as requested.2.14 Develops and maintains a file on mediators, arbitrators, and fact finders.2.15 Reviews software agreements and advises on data security matters and compliance with Federal and NYS laws and regulations.2.16 Serves as the compliance officer for all applicable state or federal laws.2.17 Attends Board meetings and other administrative meetings and offers legal counsel as pertinent.2.18 Performs other duties as assigned by the District Superintendent.3.0 Authority:3.1 Authorized to act on matters related to assigned responsibility; not authorized to act on those matters specifically withheld by District Superintendent.4.0 Reporting Requirements:4.1 Will report to and meet regularly with the District Superintendent to review progress and accomplishments in each area of responsibility
